Limitation of Liability and Indemnification

10.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HONEST FIX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY AI-GENERATED OUTPUT WILL BE ACCURATE OR COMPLETE.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HONEST FIX WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOST PROFITS, GOODWILL, DATA, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, YOUR RELIANCE ON AI-GENERATED OUTPUT, YOUR DECISION TO UNDERTAKE ANY DIY REPAIR, OR THE ACTS OR OMISSIONS OF ANY CONTRACTOR REFERRED THROUGH THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) THE TOTAL FEES YOU PAID TO HONEST FIX IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). This limitation does not apply to the extent Section 10.4 provides otherwise.

10.3 Essential Basis of the Bargain

These disclaimers and limitations reflect a reasonable allocation of risk and are an essential basis of the bargain between you and Honest Fix. They survive and apply even if any limited remedy is found to have failed its essential purpose.

10.4 Carve-outs

Nothing in this Section 10 limits liability for: death or personal injury caused by Honest Fix's negligence; fraud or fraudulent misrepresentation; or any liability that cannot be excluded or limited under applicable law.

10.5 Indemnification by User

You agree to indemnify, defend, and hold harmless Honest Fix and its officers, directors, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from: your use of the Service in violation of these Terms; your User Content; your decision to undertake any DIY repair or hire any contractor; or your violation of any third-party right. We may assume exclusive control of any indemnified matter, and you agree to cooperate in the defense.
